Terms of Service

These Terms of Service govern your use of CloudMemoir websites, apps, and related services provided by SouzBit, LLC. By using CloudMemoir, you agree to these terms.

CloudMemoir

CloudMemoir is an Apple TV memory-viewing experience for browsing and playing photos and videos from cloud providers you choose to connect, such as Google Drive or Microsoft OneDrive. CloudMemoir is not a backup service, cloud storage provider, or file-hosting service.

Your accounts

You are responsible for the cloud provider accounts you connect to CloudMemoir and for keeping those accounts secure. You may revoke CloudMemoir access through the provider account controls or by disconnecting the account in CloudMemoir when that feature is available.

You must comply with the terms and policies of any third-party service you connect to or use with CloudMemoir, including Apple, Google, and Microsoft services.

Your media

You keep ownership of your photos, videos, folders, metadata, and other content. You give CloudMemoir a limited permission to access, process, cache, display, and play connected media only as needed to provide, maintain, secure, and improve CloudMemoir.

Do not use CloudMemoir with content you do not have the right to access, view, or share.

Acceptable use

You may not use CloudMemoir to:

• violate the law or another person’s rights;
• access, copy, display, or distribute content without permission;
• interfere with CloudMemoir, connected providers, or other networks;
• reverse engineer, bypass, or weaken security controls except where allowed by law;
• upload or transmit malware or harmful code; or
• use automated systems in a way that degrades the service.

Third-party services

CloudMemoir relies on third-party platforms and services, including cloud media providers, Apple platforms, hosting providers, and network services. Those services are not controlled by SouzBit, LLC. Their availability, behavior, terms, account requirements, and outages may affect CloudMemoir.

Purchases

If CloudMemoir offers paid features, subscriptions, or in-app purchases through the Apple App Store, payment, renewal, cancellation, and refund handling will be managed by Apple unless CloudMemoir states otherwise at the time of purchase.

Changes and availability

CloudMemoir may change, suspend, or discontinue features as the product evolves. Some features may be experimental, provider-dependent, or available only in certain releases or regions.

Privacy

CloudMemoir’s privacy practices are described in the Privacy Policy. The Privacy Policy is part of these terms.

Intellectual property

CloudMemoir, including its name, logos, designs, software, website, and related materials, is owned by SouzBit, LLC or its licensors. These terms do not transfer any CloudMemoir intellectual property rights to you.

If you send feedback or suggestions, you allow SouzBit, LLC to use them without restriction or compensation.

Disclaimers

CloudMemoir is provided “as is” and “as available.” To the fullest extent permitted by law, SouzBit, LLC disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and error-free service.

CloudMemoir does not guarantee that cloud provider content, metadata, thumbnails, playback, synchronization, or account connections will always be available or accurate.

Limitation of liability

To the fullest extent permitted by law, SouzBit, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost media, account issues, or provider outages arising from or related to CloudMemoir.

Where liability cannot be excluded, SouzBit, LLC’s liability will be limited to the amount you paid for CloudMemoir in the 12 months before the claim, or USD $100 if no amount was paid.

Termination

You may stop using CloudMemoir at any time. SouzBit, LLC may suspend or terminate access if you violate these terms, create risk for the service or others, or if required by law or a third-party platform.

Changes to these terms

SouzBit, LLC may update these terms from time to time. When changes are material, CloudMemoir will make reasonable efforts to provide notice through the website, app, release notes, or other appropriate channels. The effective date above shows when these terms were last updated.
